Terms of service.

The terms that apply to using this website and to booking a stay at Villa D'Eliz.

Effective date: 30 May 2026. By using this website or by booking a stay, you accept the terms below. Together with the House Rules and the Privacy Policy, they form the entire agreement between you and Villa D'Eliz.

1. About this website and operator

villadeliz.com is the official website of Villa D'Eliz Exclusive Farm Villa, operated by its family hosts at Purok 7B, Sirawan, Toril, Davao City, Philippines ("Villa D'Eliz", "we", "us", "our"). The site shares information about the property and links to Facebook Messenger for direct bookings.

Rates, amenities, photos, availability, and policies on this site reflect our best effort to be accurate but may be updated at any time without notice. Specific terms confirmed in writing on Messenger at the time of booking control over any inconsistent statement on this site.

2. Eligibility

The lead guest making a booking must be at least 18 years old and legally capable of entering into a binding agreement under Philippine law. Bookings made on behalf of a minor must be made by a parent or legal guardian, who remains responsible for the minor's conduct throughout the stay.

3. Bookings and payments

  • Bookings are made directly on Facebook Messenger. This website does not process payments.
  • A 50% downpayment confirms your booking. No payment, no reservation.
  • Accepted payment methods: BPI bank transfer or GCash. All amounts are quoted in Philippine Pesos (PHP).
  • The remaining balance is due on or before check-in.
  • An official acknowledgement of payment is issued via Messenger; any printed receipt or BIR-mandated document will follow standard Philippine business practice.

4. Cancellations, rebookings, and refunds

The 50% downpayment is non-refundable on cancellation. One rebooking is allowed with at least ten (10) days notice before the scheduled check-in; otherwise the downpayment is forfeited.

If we are forced to cancel due to a typhoon, government order, public-health directive, force majeure event, or property issue on our side, we will offer either a full refund or a free rebooking at your choice.

Charges for damages, stains, vomit, missing items, or extraordinary cleanup are assessed separately and may be deducted from any refund. See the full refund & rebooking policy in the House Rules.

5. House rules and lead-guest responsibility

All guests must read and accept the House Rules before a booking is confirmed. These cover quiet hours (Davao City ordinance), pool hours, check-in/check-out times, group capacity, decoration policy, pet policy, stray-animals notice, charges for damages, and what to bring. Confirmation is made by replying "ACCEPTED" on Messenger.

The lead guest is solely accountable to Villa D'Eliz for the conduct of the entire booking party, including day-tour guests invited by that party. The lead guest agrees to disseminate the House Rules, ordinance reminders, and any specific instructions we provide to every member of the group. Complaints raised by members of the lead guest's own party are handled solely through the lead guest; we do not coordinate directly with individual members of the booking.

Violation of the House Rules (including violation of the Davao City quiet-hours ordinance, exceeding posted capacity, bringing prohibited items, or any conduct endangering other guests or staff) may result in immediate termination of the stay without refund and, where applicable, referral to the relevant authorities.

6. Assumption of risk

Villa D'Eliz includes outdoor amenities, including a swimming pool, a kiddie pool, a bonfire pit, a grilling area, garden grounds, and access to a rural road. Guests use all amenities at their own risk. Parents and guardians are solely responsible for supervising children under their care at all times, including in and around the pools.

The pool has no on-duty lifeguard. The bonfire pit involves open flame and hot surfaces. We provide reasonable safety information; guests are responsible for using these amenities prudently.

7. Prohibited conduct

The following are strictly prohibited on the property:

  • Any activity that violates Philippine law or local ordinance
  • Illegal drugs and any controlled substances
  • Loud music, videoke, parties, or band performances after 10:00 PM (Davao City ordinance)
  • Adhesive tape, double-sided tape, and party poppers (per the Decoration Policy)
  • Bringing additional guests beyond the agreed capacity without prior approval
  • Day-tour guests remaining past 10:00 PM
  • Commercial filming or commercial photography without prior written approval
  • Conduct that endangers other guests, the property, or our staff

8. Damages, pre-checkout inspection, and indemnification

The lead guest is jointly and severally liable for any damage to the property, missing items, or extraordinary cleanup arising from the conduct of any member of the booking party or any guest invited onto the property by the booking party. Charges are estimated honestly based on actual repair or replacement cost and are payable on demand.

Pre-checkout inspection. Our team conducts a walk-through of the villa approximately ten (10) minutes before the scheduled check-out time to identify obvious damages, stains, missing items, or extraordinary cleanup. Minor wear-and-tear is not charged. By accepting these Terms and the House Rules, the lead guest agrees that the inspection findings presented at check-out are final and not subject to dispute after departure. Concerns about a specific finding must be raised on the property before the lead guest leaves; once the party has left, the assessment is deemed accepted and payable.

The lead guest agrees to indemnify and hold harmless Villa D'Eliz, its owners, family hosts, and staff from any claim, demand, loss, damage, cost, or expense arising from (a) a breach of these Terms or the House Rules, (b) the acts or omissions of the booking party or any guest they invited onto the property, (c) the lead guest's failure to disseminate the House Rules and site reminders to their group, or (d) injury or harm caused by a guest's interaction with stray animals on the property contrary to the warnings posted in the Stray Animals notice of the House Rules.

9. Limitation of liability

To the maximum extent permitted by Philippine law, Villa D'Eliz shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of enjoyment, or emotional distress, arising from your use of the website or your stay at the property.

Our total aggregate liability arising from any booking shall not exceed the total amount actually paid by you for that booking, save where a higher liability is mandated by applicable Philippine law (including consumer protection laws).

Nothing in these Terms excludes or limits liability for death or personal injury caused by our gross negligence or willful misconduct, fraud, or any liability that cannot be excluded under applicable law.

10. Force majeure

Neither party is liable for failure or delay in performing its obligations to the extent the failure or delay results from events beyond reasonable control, including typhoon, flood, earthquake, fire, epidemic, government action, public-health directive, civil disturbance, power outage, internet outage, or disruption of essential services.

11. Intellectual property

The Villa D'Eliz name, logo, photos, and original written content on this website are the property of the owners. You may not reproduce, distribute, or use them for commercial purposes without prior written permission. Personal, non-commercial sharing (such as posting a photo of your stay on your social media with credit) is welcomed.

12. Third-party links and services

This site contains links to third-party services, including Facebook Messenger, Facebook page, Google Maps, Waze, and Apple Maps. We do not control those services and are not responsible for their content, availability, or privacy practices.

13. Disclaimer of warranties

This website is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not warrant that the site will be error-free or that defects will be corrected immediately.

14. Governing law and venue

These Terms and any booking arising from this website are governed by the laws of the Republic of the Philippines, without regard to its conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the proper courts of Davao City, Philippines for any dispute that cannot be resolved amicably.

Before initiating any formal proceeding, the parties agree to attempt to resolve the dispute in good faith through direct communication on Messenger or by telephone for a reasonable period (at least fifteen calendar days from first notice of the dispute).

15. Severability and waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. No failure or delay by Villa D'Eliz in enforcing any provision constitutes a waiver of that provision or any other provision.

16. Assignment

You may not assign or transfer your booking or any rights under these Terms without our prior written consent. We may assign these Terms in connection with a sale of the property or the operating business, on terms that preserve the substance of the rights you have under any confirmed booking.

17. Amendments

We may update these Terms from time to time. The effective date at the top of this page will be updated when we do. Material amendments will be highlighted on the home page or on this page for a reasonable period. The Terms in force at the time of your booking will continue to govern that booking unless we both agree otherwise in writing.

18. Entire agreement

These Terms, together with the House Rules, the Privacy Policy, and any booking-specific terms confirmed in writing on Messenger, constitute the entire agreement between you and Villa D'Eliz regarding your use of the website and your stay at the property. They supersede any prior or contemporaneous understanding on the same subject.
